AGREEMENT BETWEEN USER AND DanceLandFM

The DanceLandFM website (dancelandfm.com) and related online radio services are operated by DanceLandFM. The site and stream are offered to you on condition that you accept these terms, conditions and notices without modification. Your use of the DanceLandFM website, live stream, request forms or any related service constitutes your agreement to all such terms, conditions and notices.

MODIFICATION OF THESE TERMS OF USE

DanceLandFM reserves the right to change the terms, conditions and notices under which the website and services are offered, including any charges associated with their use. Continued use after changes are posted means you accept the revised terms.

THE SERVICE

DanceLandFM provides an online dance music radio service, including live presenters, Auto DJ programming, song requests, a timetable, news headlines and related content. Broadcasts and website features may be interrupted, altered or withdrawn at any time without notice. We do not guarantee continuous, error-free or uninterrupted access to the stream or site.

LINKS TO THIRD PARTY SITES

The DanceLandFM website may contain links to other websites (“Linked Sites”), including news sources, social platforms and third-party services. Linked Sites are not under the control of DanceLandFM and DanceLandFM is not responsible for their content, including any link contained in a Linked Site, or any changes or updates to a Linked Site. DanceLandFM is not responsible for webcasting or any other form of transmission received from a Linked Site. Links are provided only as a convenience and do not imply endorsement of the site or association with its operators.

NO UNLAWFUL OR PROHIBITED USE

As a condition of use, you warrant that you will not use the DanceLandFM website or stream for any purpose that is unlawful or prohibited by these terms. You may not use the service in any manner that could damage, disable, overburden or impair the website or stream, or interfere with any other party’s use and enjoyment of it. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through DanceLandFM.

USE OF COMMUNICATION SERVICES

The DanceLandFM website and related channels may include request forms, contact facilities, Discord or other social links, message areas and similar communication features (collectively, “Communication Services”). You agree to use Communication Services only to send and receive messages and material that are proper and related to the service. By way of example, and not as a limitation, you agree that you will not:

Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others.

Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.

Upload files that contain software or other material protected by intellectual property laws unless you own or control the rights thereto or have received all necessary consents.

Upload files that contain viruses, corrupted files, or any other software or programs that may damage another’s computer or our systems.

Advertise or offer to sell or buy goods or services for any business purpose, unless that Communication Service specifically allows such messages.

Conduct or forward surveys, contests, pyramid schemes or chain letters, except where DanceLandFM itself runs a stated competition.

Falsify or delete author attributions, legal notices or proprietary labels on material you submit.

Restrict or inhibit any other user from using and enjoying the Communication Services.

Harvest or otherwise collect information about others, including email addresses, without their consent.

Violate any applicable laws or regulations.

DanceLandFM has no obligation to monitor Communication Services, but reserves the right to review materials and to remove any materials in its sole discretion. DanceLandFM may terminate your access to any Communication Service at any time without notice. We may disclose information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or edit, refuse to post or remove any information or materials in our sole discretion.

Always use caution when giving out personally identifying information about yourself or others. DanceLandFM does not control or endorse content posted by users in Communication Services and disclaims liability for that content and for actions resulting from your participation. Presenter, DJ and host views are their own and do not necessarily reflect those of DanceLandFM.

SONG REQUESTS AND ON-AIR PARTICIPATION

Requests are a courtesy and are not guaranteed to be played. We may refuse, edit or delay any request. By submitting a request, shout-out or other message, you grant DanceLandFM permission to broadcast, display and reuse that content on air and on the website. Do not submit copyrighted material you do not have the right to use, or messages that are abusive, illegal or intended to identify a third party without their consent.

MATERIALS PROVIDED TO DANCELANDFM

DanceLandFM does not claim ownership of materials you provide (including feedback, suggestions, requests and messages) or post, upload or submit to the website or associated services (collectively “Submissions”). By providing a Submission you grant DanceLandFM and its necessary licensees permission to use that Submission in connection with operating the station and website, including the rights to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission, and to publish your name in connection with it where relevant.

No compensation will be paid for use of your Submission. DanceLandFM is under no obligation to post or use any Submission and may remove any Submission at any time. By submitting material you warrant that you own or otherwise control all rights necessary to grant the permissions described in this section.

INTELLECTUAL PROPERTY AND BROADCAST CONTENT

Music, speech, branding, graphics, text and other content on DanceLandFM are owned by DanceLandFM or used under licence. You may listen to the stream for personal, non-commercial use. You may not copy, record, rebroadcast, redistribute or commercially exploit the stream or website content without prior written permission, except where the law expressly allows. Station names, logos and related marks are the property of DanceLandFM. Names of other companies and products mentioned on the site may be trademarks of their respective owners.

NEWS AND THIRD-PARTY INFORMATION

UK news and sport headlines on the website are supplied by third-party sources for information only. DanceLandFM does not warrant that headlines, links or summaries are complete, current or accurate and is not responsible for the content of external news sites.

LIABILITY DISCLAIMER

The information, software, products and services included in or available through the DanceLandFM website and stream may include inaccuracies or typographical errors. Changes are added periodically. DanceLandFM may make improvements or changes at any time. Advice received via the website should not be relied upon for personal, medical, legal or financial decisions. TERMINATION / ACCESS RESTRICTION

DanceLandFM may, in its sole discretion, terminate your access to the website, stream or related services at any time, without notice.

GENERAL

To the maximum extent permitted by law, these terms are governed by the laws of England and Wales. You consent to the exclusive jurisdiction of the courts of England and Wales for disputes arising out of or relating to use of the DanceLandFM website or stream. Use of the service is unauthorised in any jurisdiction that does not give effect to all provisions of these terms. No joint venture, partnership, employment or agency relationship exists between you and DanceLandFM as a result of these terms or your use of the service. If any part of this agreement is invalid or unenforceable, that part will be replaced by a valid provision that most closely matches the original intent, and the remainder will continue in effect. These terms constitute the entire agreement between you and DanceLandFM with respect to the website and stream and supersede prior communications on that subject. These terms are drawn up in English.
